Terms of Service

These terms are an agreement between you (the business using PakkaProof, the “Seller”) and [Registered company name] (“PakkaProof”). By creating an account you confirm you are authorised to bind your business to them. The Privacy Policy forms part of these terms.

PakkaProof lets you check orders against marketplaces before packing, record packing or handover videos, seal each video with a SHA-256 fingerprint and a server timestamp, store it in write-once storage, share it with a counterparty for confirmation, and export it with a certificate under Section 63 of the Bharatiya Sakshya Adhiniyam, 2023.

PakkaProof provides evidence and the means to verify it. Whether evidence is accepted, and the outcome of any claim, is decided by the marketplace, court or other forum concerned. We do not act for you in disputes and do not guarantee any outcome.

• Record lawfully, and tell your staff and counterparties that recording takes place.
• Record each parcel in one continuous take, without editing or staging.
• Keep your sign-in details and devices secure, and manage your team's access.
• Don't use PakkaProof to create misleading evidence, record people without a lawful basis, or attempt to bypass its security or limits.

As the Data Fiduciary for your evidence, you are responsible for meeting the DPDP Act's obligations towards the people in your videos.

• Plans: Free ₹0/month, Starter ₹299/month, Growth ₹999/month, Pro ₹1,999/month, plus GST, billed monthly in advance through Razorpay.
• New accounts get a 14-day free trial. Your payment method is authorised at sign-up and first charged when the trial ends unless you cancel before then.
• Orders above your plan's monthly limit are never blocked; they are charged as overage (Free ₹0, Starter ₹1.50, Growth ₹1, Pro ₹0.75 per order) on your next invoice.
• If a payment fails we will retry and notify you; your account stays usable while we resolve it, but we may suspend new captures if it remains unpaid after [N] days.
• Fees already paid are non-refundable except where required by law. [Confirm refund policy.]

Sealed videos are locked for your plan's retention period (90 days, 12 months or 24 months). During that period they cannot be deleted or altered by you, by us or by anyone else, including on request. This is essential to their value as evidence. Downgrading or cancelling does not shorten the lock on videos already sealed.

You can cancel at any time; your plan runs until the end of the paid period. We may suspend or terminate accounts that breach these terms, with notice where practical. After termination, locked evidence stays stored until its retention period ends and you can still request exports during that time.

You own your videos and data. You grant PakkaProof a limited licence to store, process and display them solely to provide the service. PakkaProof owns the software and brand.

We work to keep PakkaProof available and secure but provide it “as is” without warranties beyond those required by law. To the extent permitted by law, PakkaProof is not liable for indirect or consequential losses, including lost claims or revenue, and our total liability in any 12 months is limited to the fees you paid in that period.

These terms are governed by the laws of India. Courts at [City] have exclusive jurisdiction, subject to any mandatory consumer protection law.
